New Delhi: A Delhi Court on September 26 directed CBI to hand over certain documents
received from Sweden to the Europe based three Hinduja brothers to enable them to
prepare their defence in the Rs 64 crore Bofors pay off case.
Special judge Prem Kumar, who had on September 25 asked CBI to spell out its stand
on the documents, which are yet to be translated from Swedish into English, ordered
the probe agency to give copies of the same to the accused.
"You (CBI) give it to them (Hindujas). They will get it translated and see if it
could help them in any way," the Court told CBI counsel U S Prasad.
The direction follows an application by accused Hinduja brothers, Srichand,
Gopichand and Prakashchand, seeking copies of some letters rogatory referred to by
the Court in its August 29 order rejecting their plea for quashing CBI chargesheet.
The Court also asked CBI to make available to the accused certain papers received
from Austria and assured that it would not let them feel handicapped for want of
documents.
CBI has already given copies of letters rogatory issued to Austria, Switzerland and
Sweden to the accused. But they would not get the second part of papers received
from Switzerland, which did not relate to them.
Having sorted out the issue of supply of documents, Prem Kumar fixed September 27
for commencement of arguments on the point of charge by the Hindujas' counsel Ram
Jethmalani.
