New Delhi: The Supreme Court on October 9 fixed hearing on October 11 on a second
contempt petition filed by Tamil Nadu against Karnataka Chief Minister S M Krishna,
Water Resources Minister H K Patil and the state chief secretary for violation of
the court orders for release of Cauvery water.
A three-judge Bench comprising justice B N Khare, justice Ashok Bhan and justice S B
Sinha fixed the hearing after the petition was "mentioned" by Tamil Nadu counsel C S
Vaidyanathan.
The petition was filed on the ground that Karnataka did not honour the Supreme
Court's October 4 order directing it to release 9,000 CUSECS water daily to Tamil
Nadu.
The earlier contempt petition, which is still pending before the apex court, accused
the respondents of not obeying the September 3 order by which Karnataka was directed
to release 1.25 TMC ft water daily.
In the present petition, the Jayalalithaa government pleaded that the neighbouring
state, by wilfully not obeying the orders of the court, had caused immense damage to
the crops and it should be compensated for that.
It also dragged the Union government into the picture by requesting the Court to
direct the Centre to issue a direction to Karnataka under Article 256 of the
Constitution for implementing the orders of the apex court.
In another plea, the Tamil Nadu government requested the court to direct the
Registry not to list any petition, appeal or application filed by Karnataka till it
implemented the court's directive.
