Mumbai: Police on October 22 submitted entire material before the Mumbai High Court
to substantiate charges framed against diamond merchant and film financier Bharat
Shah in a case of alleged nexus with the underworld.
Justice D G Deshpande accepted the material forwarded by prosecutor Rohini Salian on
the basis of which Shah had been charged with various offences under IPC and
Maharashtra Control of Organised Crime Act (MCOCA).
The court was hearing Shah's appeal challenging an order of a lower court refusing to
modify, alter and delete charges framed against him. The matter was deferred to
January 15.
Urging for early hearing, Shah's counsel Vibhav Krishna argued that the entire
exercise would be rendered in-fructuous as the trial would be complete by January 15.
However, the court did not consider his plea.
Shah has challenged an order of trial judge A P Bhangale who had framed charge
against him for threatening film personalities including Hrithik Roshan and Shah Rukh
Khan and
conspiring with others to murder them.
Shah has questioned the framing of charge of murder (section 302 IPC) on the ground
that it was "absurd" as these personalities were still alive.
Shah had urged for altering and modifying charges framed against him in the Supreme
Court. The apex court, however, asked him to move the High Court. Shah argued that
charges should be modified or altered on the basis of material on record. The trial
court, on July 22, had turned down his plea on the ground that altering or modifying
charges could be considered after the evidence was adduced.
