New Delhi: The Supreme Court on November 1 allowed the Union government to
reconstitute the Environment Protection Authority headed by Bhurelal but warned that
its composition could not be changed without its permission.
Hearing an application moved by amicus curiae Harish Salve, a three-judge Bench
headed by Chief Justice B N Kirpal said the government could issue the notification
for reconstitution of the Authority.
"But it shall not change the members of the committee without permission of the
court," the Bench said when Additional Solicitor General Mukul Rohatgi said the
committee did not have a single member who was an expert on environmental
issues.
The court had appointed the Bhurelal Committee to suggest ways and means to protect
the environment across India.
