New Delhi: Europe-based NRI businessman Srichand Hinduja moved the Delhi High Court
seeking quashing of the Central Bureau of Investigation (CBI) chargesheet against
him in the Rs 64 crore Bofors pay off case on the ground of delay in probe after two
of his brothers had filed similar petitions earlier.
A Bench comprising Justice Usha Mehra and Justice R C Jain posted the hearing in the
matter to November 20, when the writ petitions by the other two brothers, Gopichand
and Prakashchand Hinduja, seeking quashing of the chargesheet on the ground of
alleged "inordinate delay" in investigating the case by CBI would be taken up.
The three brothers have filed revision petitions against the order of Special Judge
Prem Kumar, who had rejected their applications for quashing of the chargesheet on
August 29.
They have challenged the trial court order claiming that the special judge
had "failed" to appreciate their contentions with regard to the "delay" in probing
the case by the CBI.
The special judge in his order had said that the nature of offence and other
circumstances did not warrant such a relief to them at this stage in the interest of
justice.
Hindujas' counsel Ram Jethmalani had earlier argued that the delay in probing the
case by the CBI was reflected from the fact that the case came to light in 1986 but
was still at the stage of argument on framing the charges.
The special judge has already fixed November 14 for pronouncing his order on point
of charge after concluding the hearing of the arguments by the CBI and Hindujas'
counsel.
