Islamabad: The Lahore High Court has dismissed a petition challenging the legality
of Legal Framework Order (LFO), which incorporates Pervez Musharraf's election as
President through a referendum as well as his controversial Constitutional
amendments, on the grounds the issue should be addressed by the Supreme Court.
The President was vested with the power to amend the Constitution by the apex court
and as such it was for the same court to see whether he has transgressed the
authority conferred upon him by promulgating the LFO, Justice Muhammad Saeed Akhtar
of the Lahore High Court observed while disposing writ petition filed by Pakistan
Lawyers Forum challenging the validity of the LFO.
After recording the arguments of the petitioner's and government counsel, the judge
observed that the transfer of power from the armed forces to the civil society had
always been difficult but not impossible. The government is in the offing and the
leadership emerging from the recent polls should be able to find a solution to the
problem.
"The country could not be plunged into chaos, confusion and instability at this
juncture of time and the question may be left to be determined by the proper forum,"
he said.
A petition in this regard was already pending before the Supreme Court.
