New Delhi: The Supreme Court on April 28 said the trial court, in accordance with a Bombay High Court order, would hear noted film financier Bharat Shah's plea for quashing of a charge accusing him of conspiring with the underworld to eliminate noted film stars, at the end of the recording of evidence in the case.

A Bench comprising Justice M B Shah and Justice Arun Kumar said that as the recording of evidence was in the final stages and 72 witnesses have been examined leaving only the investigating officers' examination, no interference with the High Court order was called for at this stage.

Shah's counsel Kapil Sibal stated that for one year the plea of his client for quashing of the charge for allegedly conspiring to eliminate film stars has been hanging and no court was ready to hear it.

He said there was not even a whisper, as per prosecution evidence, that Shah conspired at any point of time to eliminate film stars even as the courts were not addressing to his grievance that charge has been framed wrongly.

Appearing for the prosecution, senior advocate K T S Tulsi said that there was enough evidence against the accused relating to conspiracy and that whether or not there was a conspiracy could be determined only after completion of the recording of evidence.

At the conclusion of arguments, the Bench said, "The High Court order is not to be disturbed and the trial court would act in accordance with the High Court order."
