Judge Sodhi accuses CBI official of coercion
Friday, May 2 2003 20:22 Hrs (IST)
New Delhi: In a major accusation, Delhi High Court Judge, Justice R S Sodhi, on May 2 charged an
unnamed Central Bureau of Investigation (CBI) official of "interfering with the course of justice"
by "conveying" to him "to be careful" in hearing a petition filed by former Enforcement Deputy Director
Ashok Agarwal.
During the hearing of the petition in which senior advocate Ram Jethmalani was arguing, Justice Sodhi
came down heavily on the investigating agency and asked its investigators to behave.
Narrating the incident, the Judge said that recently a CBI official "called on" him and "sort of conveyed"
that he should be careful while hearing the petition of Agarwal.
"I asked him to behave and warned him that he was interfering with the course of justice," he observed.
Agarwal was charge sheeted by CBI on charges of corruption and wrongful confinement for allegedly
framing a Delhi-based jeweller Subhash Barjatiya in a 15,000 dollar Foreign Exchange Regulation Act
(FERA) violation case on the basis of a fax message purportedly issued by a Swiss bank.
The accused had filed the petition in the High Court accusing CBI of "cooking up" some documents
leading to his longer period of detention and had sought inquiry against the investigating officer.
