AG, Bar Council favour National Judicial Commission

New Delhi: Amid growing incidence of alleged involvement of judges in various scandals, Attorney
General (AG) Soli J Sorabjee and Bar Council of India have favoured setting up of a National Judicial
Commission (NJC) to deal with such "deviant judges" as the "process of impeachment gets politicised."
"Just implement the recommendations of Constitution Review Commission for creation of a National
Judicial Commission soon and very soon. It will help deal with deviant judges," Sorabjee said.
Referring to the arrest of former Delhi High Court Judge Shamit Mukherjee in Delhi Development
Authority (DDA) scam, Sorabjee said it was "depressing for every one".
Echoing similar views, Bar Council of India Chairman D V Subba Rao called for "urgent corrective
measures" to deal with "deviant judges. Judicial accountability is the need of the hour."
"Some corrective mechanism has to be put in place as impeachment is illusory and judiciary's in-house
mechanism has also failed to serve the purpose," Rao said.
Terming Mukherjee's arrest as "very unfortunate", he said "If what has been alleged is true, it will father
erode people's faith in the Judiciary as it comes in the wake of scandals involving some judges of the
High Courts of Punjab and Haryana, Rajasthan and Karnataka".
"Though the charges against Karnataka Judges have been dropped, still it requires a lot of introspection
in the Judiciary," he said while pointing out that the Council had been agitating for the NJC for over a
decade.
