Sanjay exempted from personal appearance in court
Monday, May 19 2003 18:25 Hrs (IST)

Mumbai: A special court on May 19 exempted film actor Sanjay Dutt and 86 other accused in 1993 bomb blast case for varying periods and directed Central Bureau of Investigation (CBI) to make submissions on May 21 on the issue of joining co-accused Ejaz Pathan and Majnu Mustaffa in the same trial.

In keeping with a judicial order, Sanjay and 86 other accused on bail appeared before designated judge P D Kode.

Sanjay has been permitted to visit UK, USA and Canada from May 22 to June 30 to perform IN stage show "Jalwa-2003".

He is exempted till then. However, the court asked his Lawyer Farhana Shah to represent him in his absence and Sanjay was warned not to maintain contact with absconding accused.

Other accused were exempted till May 26.

In a related development, the court deferred till May 26 the plea of accused Salim Durrani to grant him permission to visit his native place Tonk in Rajasthan for 30 days to cultivate his land.

He belongs to the princely family of Tonk and his source of livelihood is agriculture. However, for the last four years, Tonk is reeling under severe drought conditions.

Meanwhile, arguments would continue on May 21 joining co-accused Ejaz Pathan and Majnu Mustaffa in the trial who were deported recently from Dubai and arrested at the stage when trial in the main case has already reached its fag end.

CBI has already submitted a list of five witnesses it proposes to examine against Ejaz. In case of Majnu, a legal issue has cropped up because his name does not figure in the file of accused or absconding accused filed by CBI in the court. His involvement figured in the confession of co-accused.
