Highlights of SC judgement on professional colleges

New Delhi: Following is the highlight of a significant judgement given on August 14 by the Supreme
Court on the mode of selection of candidates for private professional colleges and unaided minority
educational institutions
(UMEIs).
-Institution must have freedom to fix its fee structure
-There can be no profiteering
-Capitation fees cannot be charged
-Committee headed by retired HC judge in each state to check the validity of the fee structure
-Profit/surplus funds of an institution cannot be diverted to another institution or for another purpose
-Governments to frame appropriate legislation to cancel affiliation or derecognise institutions charging
capitation fee
-Private colleges and UMEIs do not stand in the same footing as the latter enjoys protection under
Article 30 of the Constitution
-Governments to fix management quota of UMEI keeping in mind the interest of the community in that
state
-Common entrance test for filling management quota
-Vacant management quota seats to go to general pool
