Ahmedabad: The special Prevention of Terrorism Act (POTA) court on October 14 reserved its order for
October 17 on a regular bail application filed by 11 accused in Godhra train carnage case.
Arguments on the matter by advocates L R Pathan and Y A Charkha, representing the 11, and special
public prosecutor H M Dhruv concluded in Ahmedabad at the court of POTA judge Sonia Gokani.
The regular bail application moved under section 439 of Indian Penal Code (IPC) stated that the
investigating agency had falsely arrested the accused in connection with the train carnage.
Charkha said the 11 were actually arrested for curfew violation and then were charged for being part of
the mob that attacked the S6 coach of Sabarmati Express on February 27.
H M Dhruv said that the accused were allegedly part of the mob that attacked the ill-fated coach and
there was a prima facie case against them as they were armed, even if they did not personally attack the
coach along with several others in the mob.
The prosecution lawyer added that the charges levelled against one of the 11 accused, Mohammed
Hussain Kalota, a former Congress corporator from Godhra, were more serious and that he allegedly
provoked the mob to attack the coach.
Over 125 persons were named accused in the case, including those absconding, and POTA charges
were slapped on them.
