Godhra: POTA Court rejects bail plea of 4 accused

Ahmedabad: A Special POTA (Prevention of Terrorism Act) Court today (November 4) rejected the bail
plea of four persons, allegedly involved in the Godhra train carnage, and reserved for November 5 its
order on bail application of six others.
On defence plea, POTA Court Judge Sonia Gokani also deferred to November 7 the hearing on bail
application of 10 other accused in the same incident.
These 10 accused have urged for bail through separate petitions, court sources said.
Gokani rejected through a common order, the bail plea of four - Mujhfar Usman Hayat, Mohammad
Abdul Rahim Kala, Shabbir alias Bhupatno Bhurio and Mohammad Saeed Abdul Salam Badam - who
had filed separate applications early last month.
While Hayat and Kala were arrested on July 25 and March 14 last year, Badam and Shabbir were
nabbed on April 10 and September 21 last year, by the Special Investigating Team (SIT).
Court observed that the presence of these four accused near S-6 coach of the train was testified by
witnesses and the trial in the case is likely to commence soon.
Rejecting the bail, the court upheld prosecution's argument that the accused had been charged for their
alleged involvement in criminal conspiracy and their act (of allegedly torching the S-6 coach of
Sabarmati Express) was with an intention to strike terror in the minds of people.
