Court dismisses cheating case against Ajit Jogi

New Delhi: In a major relief to Chhattisgarh Chief Minister Ajit Jogi, a Delhi court today (Nov 28)
dismissed a complaint accusing him of "concealing facts" and filing "false and fabricated affidavit" for
procuring a petrol pump in New Delhi as an MP in 1994, saying the offence of cheating had not been
completed as the pump had not been allotted to Jogi.
Metropolitan Magistrate Nivedita Anil Sharma, while rejecting the complaint filed by the Leader of the
Opposition in Chhattisgarh Nand Kumar Sai of Bharatiya Janata Party (BJP), also observed that there
was a lapse of more than 8 years since the date of incident and this had not been explained
satisfactorily, Sai's counsel B M Agarwal said.
Also, since the documents were alleged to have been filed before the Oil Selection Board (OSB), the
complaint must also have been made by the Board, Agarwal said quoting the order.
On the allegation that Jogi furnished false evidence, the court said it could take cognizance of this only if
the same had been done before a body discharging judicial functions unlike the OSB.
Sai in his complaint alleged that Jogi furnished false affidavit about his family income and residence
proof before the OSB while applying for the pump.
However, Jogi gave up the pump allotment after the matter attracted attention, the complaint
alleged.
Reacting to the order, Sai's counsel B M Agarwal said he would lose no time to approach the High Court
against the dismissal.
