Salman not to be tried for culpable homicide now: SC

New Delhi: The Supreme Court today (Dec 18, 2003) gave relief to actor Salman Khan by ordering that the charge of culpable homicide should not be added at present in the trial proceedings against him in a rash-and-negligent driving case.

A Bench comprising Justice N Santosh Hegde and Justice B P Singh set aside both the high court orders, quashing the culpable homicide charge and the sessions court's order framing the culpable homicide charge.

The court ordered that the trial will proceed for a magistrate court at Bandra, if, at a later stage, it finds sufficient evidence to frame culpable homicide charge under Section 304-II Indian Penal Code (IPC) against Khan.
