Taj case: Mayawati may not be arrested till polls Friday, January 30 2004 18:25 Hrs (IST) New Delhi:
Bahujan Samaj Party (BSP) leader Mayawati is unlikely to be arrested in the Taj Heritage Corridor scam case till the forthcoming elections as the Central Bureau of Investigation (CBI) has been advised by the Government not to move the Supreme Court challenging an Allahabad High Court order restraining the agency from arresting her in the case.
"It will not appear proper for the CBI to move the apex court just before the elections to seek arrest of an Opposition leader who had been criticising the Government. It would rather send wrong signals in a Democracy," highly-placed sources in the Government said today (Jan 30, 2004).
The Government had sought opinions of Law Minister Arun Jaitley and Attorney General Soli J Sorabjee on the filing of appeal by CBI challenging the order of the Lucknow Bench of the Allahabad High Court restraining CBI from arresting her and other officials against whom first information report (FIR) had been registered by the agency on the directions of the Supreme Court.
"Both Jaitley and Sorabjee opined against moving the apex court as they felt that it would be better if the agency moved the High Court seeking revision of its October 22 order," they said.
The High Court had restrained CBI from arresting her in the Rs 175 crore Taj Heritage Corridor scam case and the disproportionate assets case till the conclusion of the investigations.
