Cancel polls where criminals are in fray: HC to EC

Patna: The Patna High Court today (April 30, 2004) asked the Election Commission to consider countermanding the elections to the constituencies where the prisoners, whose voting right have been suspended under the election laws, had entered the fray.

A Division Bench comprising Chief Justice Ravi S Dhawan and Justice Shashank Kumar Singh passed the order on a public interest litigation (PIL) seeking disqualification of those who entered the poll fray from jail and whose voting rights were automatically suspended by the law.

The Bench ordered the Commission to consider whether it would countermand the elections to constituencies where such persons were in the fray before declaration of results.
