"Fake Killing" trial disallows personal allegations Tuesday, June 1 2004 12:52 Hrs (IST)

The military court, recording summary of evidence in Siachen "fake killing" case, today (June1, 2004) disallowed taking on record personal allegations levelled by the then commanding officer of Gorkha rifles against his Junior officer.
Presiding officer of the court Brig Philip Campose ruled against the recording of personal allegations against Maj. Surinder Singh levelled by Col. K D Singh during his continuing deposition for the fifth day.
The objection was raised first by Maj. Singh when Col. Singh said that the charges of major that he fabricated fake encounter on Line of Control (LoC) in Siachen Glacier region in August last year at the instance of his senior officer was false.
"Maj Singh is levelling these charges to tarnish my image and he is doing this because he knows he is doomed and wants to demolish me also," Col Singh said.
Maj Singh quickly objected to the personal insinuations. He was also supported by independent witness maj Ajay Kumar Yadav who said personal allegations should not be recorded.
Accepting the objections Brig Campose said that no personal allegations would go into record and the recording of summary evidence would go strictly by rule of law.
The summary of evidence is being recorded as a follow up of a court of inquiry, which held Col D K Singh and Maj R Lamba responsible for administrative lapses and recommended disciplinary action against Maj Surinder Singh for making exaggerated claims.
Maj Singh had alleged that Col Singh had asked his juniors to arrange fake killings in Siachen.
