Mumbai:
A Railway court today (June 18, 2004) rejected the bail plea of film director Kaizad Gustad and his assistants Ashish Udeshi and Hadley D'Mello charged with culpable homicide not amounting to murder in the case of accidental death of upcoming director Nadia Khan.
Railway Magistrate P T Rahule observed that it would not be proper to grant them bail at this juncture as investigation was incomplete and police had to record the statements of witnesses.
The trio were yesterday remanded to judicial custody till July one.
During a film shooting on railway tracks at Mahalaxmi railway station, Nadia was hit by a speeding train and declared dead on arrival at a hospital on May 25. However, Gustad's team had filed a police complaint saying she was killed in a road accident.
Prosecution opposed their bail on the ground that investigation was incomplete and that they had to record the statements of witnesses including railway staff, employees, film producer and a cameraman.
The court was told that witnesses were not readily coming forward to give statements and hence this process was taking time.
