POTA committee asks TN to produce 'Vaiko case' record Friday, September 3 2004 18:58 Hrs (IST)

The Central POTA (Prevention of Terrorism Act) review committee has asked the Tamil Nadu chief secretary to produce on September 10 the entire case record pertaining to a petition by MDMK (Marumalarchi Dravida Munnetra Kazhagam) chief Vaiko challenging the legality of Jayalalithaa Government's decision to invoke POTA charges against him.
The Committee, headed by Justice Arun B Saharya, asked the chief secretary to "appear through an authorised representative accompanied by the Investigating Officer, fully conversant with the case, and produce the entire record of the case for final hearing and disposal of the said complaint".
The hearing would be held at a specially set up courtroom in the high-security Vigyan Bhawan Annexe in New Delhi.
Earlier, the Tamil Nadu Government had submitted materials pertaining to the case to the committee in three bound volumes in sealed covers with replies praying that the complaints be dismissed.
The State also pleaded claim of privilege against disclosure of documents to the accused on the ground that the chargesheet in the case was yet to be
filed.
Therefore, it may not be possible to furnish copies of the documents to the accused at this juncture, as it would greatly prejudice the trial, it added.
The State Government had also told the Committee that Vaiko lauds LTTE's (Liberation Tigers of Tamil Eelam) terrorist activities whenever he delivers a speech and seeks support and sympathy for the banned organisation in India and all over the world.
The counsel said the Tamil Nadu Government had "rightly" charged Vaiko under the tough anti-terrorism law, as there was a "prima facie" case against him.
