Lodha to file original of Priyamvada's registered Will

Kolkata: The Calcutta High Court today (Sep 10, 2004) directed Rajendra Lodha to file the original of Priyamvada Birla's registered Will of 1999 by which he has claimed the Rs 5000 crore worth assets of M P Birla group.

Taking note of a report from the Testamentary Department of the High Court which pointed out few anomalies in Lodha's probate application, Justice Kalyanjyoti Sengupta directed his solicitor firm Fox and Mondal to file the original of the registered Will and supplementary affidavits correcting the other flaws.

Justice Sengupta observed that while Lodha sought dismissal of the probate petitions of the Birlas for not attaching the originals of the mutual "Wills" of 1982 by M P Birla and Priyamvada Birla in their probate applications, why should the same not be considered in his case as Lodha also did not file the original of the registered Will.

Justice Sengupta directed Lodha's solicitors to appear before his court next Tuesday in this regard.

While Lodha filed the original of the unregistered Will of Priyamvada, he filed a photocopy of the registered Will.

The report also pointed out that while the Will, copy of the which was submitted before the department, says "I hereby appoint Rajendra Lodha as the executor of this Will," the probate application says "sole executor".

Another anomaly pointed out was that while the Will spells the name of a witness as "Dr Madan S Vaidya", the probate application spells his name as "Dr Madanlal Sagarmal Vaidya."
