Citing pesticide contents will deny us privacy: Pepsi Thursday, November 4 2004 18:15 Hrs (IST)

The Rajasthan High Court has rejected a review petition moved by Coca Cola and Pepsi against the court's earlier judgement to specify the composition of ingredients and pesticide contents if any on the product, bottle, rapper, cans or package.
The division bench of Justice S K Keshote and Justice K S Rathore out rightly turned down the review petition moved by former Law Minister Arun Jaitley on behalf of Coke and Iqbal Chhagala on behalf of Pepsi in Jaipur yesterday (Nov 3, 2004).
The two cold drink giants have challenged the court's earlier order alleging that the directions would force them to compromise with their commercial confidentiality.
It was argued that passing such directions was only in the domain of legislature and the executive and not of the courts.
On October 8, in its judgement on a PIL (Public Interest Litigation) moved by advocate Swati Bhati, the Rajasthan High Court's division bench comprising Justice Anil Dev Singh and Justice K S Rathore ordered the soft drink and beverages companies including Pepsi and Coca Cola that they print the ingredients and pesticide contents, if any, of their products on the product bottle or package.
The order said in view of Articles 19a and 20a of the Constitution the manufacturers of beverages or any other soft drinks are bound to clarify and clearly specify the composition and nature of quality of pesticides and chemicals in their products.
The previous judgement has considered the joint parliamentary committee's recommendations while allowing the writ petition.
Mrs Swati, who pleaded her case, said she had filed the PIL in 2003.
