Sanjay, 84 accused exempted from personal appearance

Mumbai: A special court today (Nov 6, 2004) exempted 85 accused in 1993 bomb blast case, including Bollywood star Sanjay Dutt, from personal appearance till December 2 and also allowed the actor to go to Kolkata for a month from November 11 for shooting of a film.

In a related development, the court also allowed 12 accused to visit their native places during Diwali vacation.

Designated judge P D Kode asked all the accused, who are on bail, to appear before him on December 3 when he would announce the date of verdict.

Thirty six other accused, lodged in the central prison, were also produced before the designated TADA court in Mumbai.

On a plea made by Sanjay's lawyer Farhana Shah, the court allowed him to visit Kolkata for a month from November 11 for shooting of film "Parineeta" but asked the actor to appear on December 3 when other accused had been summoned to the court.

The actor has been warned not to tamper with evidence and not to misuse bail conditions. He has also been told that he would have to appear before the court within 48 hours of notice in case his presence was required.

Sanjay is facing the charge of possessing an AK-56 rifle and destroying the weapon. CBI has alleged that underworld don Abu Salem had gone to his residence along with other accused to deliver the weapon.

The actor has denied the charges and the witnesses also did not support the prosecution's case. CBI examined 686 witnesses and the evidence has crossed 13,000 pages. The accused are charged with carrying out serial blasts on March 12, 1993, killing 256 people and injuring 713 besides damaging property worth Rs 27 crore.
