Seer bail application arguments adjourned to Dec 6 Thursday, December 2 2004 16:34 Hrs (IST) - World Time

The Madras High Court today (Dec 2, 2004) adjourned to Monday (Dec 6, 2004), the arguments on the bail application filed by Kanchi Mutt Seer Jayendra Saraswathi, who was arrested on Nov 11 in connection with the murder of a Kancheepuram temple official.
Justice R Balasubramaniam adjourned the hearing after public prosecutor K Duraisamy sought time on the ground that Supreme Court lawyer K T S Tulsi could come to the court only on Monday to reply to additional citations put forward by the Seer's counsel, I Subramanian.
Yesterday, Subramaniam (Seer's counsel) had made a reference in the court to an apex Court ruling to show that Section 439 CrPC could be read independently without reference to Sec 437 CrPC, as Tulsi had attempted to establish.
Justice Balasubramaniam said if Sec 437 was the guiding factor, it would be different. However, under Sec 439, the court had absolute power, he pointed out.
After the public prosecutor had sought the adjournment, Subramanian said the Seer could be granted interim bail till then. Finding no response coming from the judge, he then sought to raise the citations made yesterday.
The public prosecutor said it could not be erased, to which submission, the judge said it had also entered his mind that the submission cannot be erased.
