Seer's assault case bail plea adjourned to Dec 6

Chennai: The Principal Sessions Court in Chennai today (De 3, 2004) adjourned to Monday (Dec 8, 2004) the hearing on the bail application filed by Kanchi Shankaracharya Jayendra Saraswathi in the case relating to the assault of Radhakrishnan, a former associate of the Kanchi Mutt.

Principal Judge P Murugesan adjourned the hearing after city public prosecutor T V S Ganesh informed the court that senior Supreme Court lawyer, K T S Tulsi, would argue for the prosecution on the bail application on Monday afternoon after he appeared in the Madras High Court in connection with the Seer's bail plea in the Sankararaman murder case.

The Shankaracharya was first arrested in the murder case as the prime accused on November 11 and later in connection with the assault of Radhakrishnan in Chennai in 2002.

Directing the Public Prosecutor (PP) to file a counter later today, the judge made it clear "there will be no adjournment."

Earlier, advocate K S Dinakaran, appearing on behalf of the Seer, had sought an assurance from the PP that Tulsi argue the case on Monday.

He alleged that ever since the Dravidian parties entered politics, "they built everything on dead bodies. All unsolved cases were now being pursued against the Mutt," he alleged.

Seeking adjournment, the PP submitted that it would not cause any hardship to the Seer as he had been placed in judicial custody till December 10 in connection with Sankararaman murder case.

Responding to a claim by Dinakaran that the assault case, which took place two years ago, had no connection with the murder case, the PP said Tulsi would argue that point before the court and place relevant materials.

Tulsi is due to appear on Monday in the court of Justice Balasubramaniam to reply to the additional Supreme Court rulings put forward by I Subramaniam, senior counsel, who is representing the Seer in the murder case, to support his argument that the court could grant bail under Sec 439 CrPC and need not have to read that section along with Sec 437 as wanted by Tulsi.
