Mumbai:
The Bombay High Court today (Dec 13, 2004), stayed the summons issued by a special court to encounter specialist police sub inspector Daya Nayak, asking him to appear in person to reply the allegations about his financing a school in Karnataka with the help of underworld money.
Staying the summons, Justice A M Khanvilkar said there was no urgency in the matter and posted the matter for next hearing. The date, however, of which was not fixed.
Nayak filed an application in the High Court seeking quashing of summons issued to him by a special court.
In his petition, Nayak said that the order to investigate the funds of Rs 1 crore provided to the school built by him in his hometown of Mangalore, was "bad in law".
On December 6, designated Judge A P Bhangale had issued the summons to Nayak to appear on December 15.
The judge's order had come on a private complaint filed by former journalist Ketan Tirodkar alleging that Nayak had links with Pakistan-based gangster Chhota Shakeel and that funds obtained from the underworld was used by him to build a school in Karnataka.
Nayak shot into controversy after he killed more than 80 gangsters in police encounters. Following allegations made by Tirodkar, the police chief shunted him from the crime branch to a local police station in suburban Kandivli.
