Bail application of Kanchi Seer adjourned to Dec 27 Thursday, December 23 2004 16:08 Hrs (IST) - World Time -

The Madras High Court today (Dec 23, 2004) adjourned to Monday (Dec 27, 2004), the hearing on the bail application of Kanchi Seer, Jayendra Saraswathi, in the 'Radhakrishnan assault case.'
The bail plea came up for hearing before Justice R Balasubramaniam in the Madras High Court today.
The adjournment came after senior advocate, K T S Tulsi, appearing on behalf of the prosecution, sought time till December 27 to show that Sec 437 (1)(i) also applied to offences under sec 307 IPC (attempt to murder).
The Seer's advocate, Satyanarayanan, pointed out that the assault of Radhakrishnan, his wife and an attendant, had taken place in Chennai over two years ago.
He contended that the assailants had been identified during an identification parade and the weapons allegedly used in the attack were recovered from under a water tank.
He pointed out that the Seer was aged, and sought grant of bail while assuring the court that if it was granted, the Shankaracharya would not tamper with evidence and was willing to accept any conditions laid down by the court.
Section 437 (1) (i) CRPC says when a person suspected to have committed any non-bailable offence is arrested, such person/persons shall not be released if there is reasonable ground for believing that he has committed an offence punishable with death or life imprisonment.
