The appeal filed by Kanchi Junior Seer Vijayendra Saraswathi in Madras High Court challenging dismissal of his plea for bail by a sessions court on January 27 in the Sankararaman Murder Case and seeking bail was returned this evening (Feb 1, 2005) due to some 'technical' defects.
In his application filed earlier in the day, Vijayendra had said the Principal Sessions Judge (PSJ) Chengalpattu had dismissed his bail application without "properly appreciating the facts, circumstances and judgment" of the Supreme Court, which granted bail to Kanchi Seer Jayendra Saraswathi in the same case.
Stating that the PSJ's order was 'unsustainable in law and facts', he claimed that the Apex Court had considered all materials submitted by the prosecution before concluding that "prima facie a strong case has been made out for grant of bail."
