Prosecution told to produce report of Zaheera's kin Saturday, March 5 2005 10:30 Hrs (IST) - World Time -
Mumbai:
A special court hearing the Best Bakery case yesterday (Mar 4, 2005) directed the prosecution to produce the police report on statement given by mother and brother of prime witness Zaheera Sheikh over "threats" they faced from Bharatiya Janata Party (BJP) MLA Madhu Shrivastava.
The directions were issued by the court after senior police inspector R K Chavan told the court that he had only recorded the statements of Zaheera and further added that he could not remember if he had recorded the statements of her mother Sehrunissa and brother Nasibullah.
"My portfolio within the Santacruz police station was changed on January 9, 2004 and hence I do not remember certain things," he told the special court in his cross-examination.
The court has also asked Chavan to produce by Monday (Mar 7, 2005) the report he had sent to his superiors after recording the statement of Zaheera.
Chavan had earlier told the court that he had recorded Zaheera's statement and this was in total contradiction with what she had testified in court during the re-trial.
Zaheera had told the court earlier that Santacruz police had not recorded her complaint of threat. She said that activist Teesta Setalvad had brought some documents, which she signed.
The court is hearing re-trial into the March 1, 2002 attack on Best Bakery at Vadodara in the aftermath of Godhra train carnage in which 14 persons died.
