Will case: Birlas to file appeal in Calcutta HC

Kolkata: Birlas today (May 6, 2005) decided to file an appeal in Calcutta High Court against a single judge order rejecting the caveatable interest of three members of the Birla family in the Priyamvada Birla will case.

The appeal would be filed today and it is expected to be heard by a division bench next week, Birla's counsel N G Khaitan

Justice Kalyanjyoti Sengupta had earlier ordered that K K Birla, B K Birla and Yashovardan Birla had no caveatable interest in the probate petition filed by R S Lodha for legal authentication of Priyamvada Birla's purported will.

Lodha, a chartered accountant, had claimed that the entire assets of the M P Birla group had been bequeathed to him by Priyamvada Birla who died in July last year (2004). Birlas, however, had challenged his claim.
