Karnataka High Court today (Jun 6, 2005) dismissed IAF Flying Officer Anjali Gupta's writ petition seeking quashing of General Court Martial (GCM) proceedings against her.
She had prayed the Court to quash proceedings of GCM against her, the chargesheet against her and also challenged the convening of the GCM to try charges against her.
After hearing the counsels for the parties and after going through the records, Justice K L Manjunath observed that in the circumstances the Court does not see any reason to interfere with the proceedings, and dismissed the petition.
The 28-year-old officer is facing charges of indiscipline, insubordination and financial irregularities.
At the GCM today, the military court read out proceedings pertaining to cross-examination of the former adjutant of Aircraft Systems and Testing Establishment (ASTE), Wg Cdr R S Chaudhary regarding Gupta's absenteeism from morning briefings and PT.
Gupta sought clarifications and made some additions.
Her written application seeking a copy of the court recordings since the GCM began its proceedings against her was turned down by the court.
Meanwhile, Gupta has sought change in the venue of GCM trial, alleging that the ongoing trial at the training command here is "vindictive", the entire atmosphere is "malicious" against her, and the trial is "biased".
In a letter to the IAF Training Command Chief, a copy of which had been sent to the President A P J Abdul Kalam and the Chief of Air Staff Air Chief Marshal S P Tyagi, she said, "For fair, just and reasonable trial, I request for a change in the place of trial, preferably in Delhi".
