Court asks CBI to file reply on Telgi's request

Pune: The special MCOCA court hearing the multi-crore fake stamp case, today (Jun 20, 2005) asked CBI to file its say by June 28 on prime accused Abdul Karim Telgi's application that he be shifted from "anda cell" to Suraksha-II of the Yerwada Central Prison.

Telgi had filed an application before the court sometime back saying that keeping him in 'anda cell' was contravention of the Supreme Court observations made from time to time against keeping prisoners in seclusion.

Appearing for Telgi, advocate Harshad Nimbalkar argued before the court of Special Judge P R Deshpande that the Supreme Court too had observed in the matter of Sunil Batra and Charles Sobhraj that even a condemned prisoner cannot be held in solitary confinement.

Telgi in his application said that he should be shifted to Suraksha-II where his brother, nephews and other co-accused in the case are lodged to allow him to move, mix, mingle talk and share company with them including his advocate Abdul Rasheed Kulkarni.

Judge Deshpande asked the prosecution to file its say by June 28.

The court also took up for hearing the June 8 applications of Telgi and former MLA Anil Gote, also an accused in the stamp case, seeking permission to be allowed to be treated at private hospitals for their various ailments.

Though the CBI has given its no-objection to the applications of Telgi and Gote, it has asked the court to ensure adequate security arrangements before allowing them to take treatment at private hospitals of their choice as they were high-risk security accused.

With regard to Telgi's application, Judge Deshpande sought a report in this regard from the Government-run Sassoon Hospital, while on Gote's plea, he wanted both the prosecution and defence counsel to show at least one precedent.

Telgi is afflicted with HIV and is also diabetic and Gote on the other hand, who is undergoing treatment at private Ruby Hall, wants to take recourse to naturopathy at a clinic on city outskirts, is a heart patient and has undergone a number of surgeries, including for prostrate.
