The Defence team in the Best bakery case today (Jun 27, 2005) filed an application before the trial court in Mumbai urging for issue of summons to the Commissioner of Police of Vadodara to testify whether police had maintained lock-up register to register the movements of the accused.
Defence advocate D S Jambhulikar told sources in Mumbai that the prosecution had earlier given a statement before the special judge Abhay Thipsay that there was no such register at the police station.
However, he said they had learnt from the accused that there was a lock-up register, which was maintained to record the movements of the accused.
"We feel the prosecution is trying to conceal something from the Defence," Jambhulikar said.
The prosecution would file a reply on the application tomorrow (Jun 28, 2005).
Meanwhile, Jambhulikar said the cross examination of investigating officer P P Kanani continued today and Kanani said he had filed the chargesheet even before he completed the investigations as he did not want the accused to get bail.
Kanani further said he did not file a supplementary chargesheet in the case.
Kanani earlier said that they did not keep a lock-up register at the police station.
Kanani also said that he had not made entries of the accused while they were in the lock-up and also said that there was no police register.
