The Supreme Court today (July 4, 2005) rejected the Tamil Nadu Government plea to stay the Madras High Court judgement striking down a recent State Government order abolishing the CET with immediate effect.
"Let the students be admitted on the basis of the Common Entrance Test. No case is made out for any interim relief," a bench comprising D M Dharmadhikari and Justice S H Kapadia said refusing to even issue notice on the State Government's appeal.
The matter will be heard after the summer vacation.
The Madras High Court's June 27 order gave a sigh of relief to thousands of students who had secured admissions to professional courses in Tamil Nadu on the basis of CET.
Students who had secured admissions to professional courses and who had improved their 12th standard marks through the Improvement Examination (IE) were also given relief by the First Bench, comprising Chief Justice Markandey Katju and Justice F M Ibrahim Kallifulla, of the Madras High Court. It was held that the IE would be valid for current academic year.
Allowing a batch of over 400 petitions filed by students challenging June 9 Government order, the Judges said they were not inclined to interfere with the order on IE as it was a policy decision. However, since the IE had already been held and results declared, it would not be proper on the part of the State Government to cancel it from this year.
