Rs 66.65 crore asset case: NBW against Dinakaran Tuesday, July 12 2005 13:10 Hrs (IST) - World Time -

The Special Court today (July 12, 2005) issued a Non-Bailable Warrant (NBW) against T T V Dinakaran, one of the accused in the Rs 66.65 crore disproportionate asset case filed against Tamil Nadu Chief Minister J Jayalalithaa and others following his failure to appear before it in compliance of a July two summons.
The Special Court Judge A S Pachhapure ordered issue of NBW against Dinakaran returnable by July 16, the date to which the hearing has been adjourned to.
The Judge informed the counsels that the Special Court in Chennai has written a letter requesting him to take possession of the seized properties including jewels in response to the trial court's July two order for transferring them to the City.
The Judge Pachhapure rejected the pleas by Dinkaran, submitted by Jina Senan, seeking time till July 18 for his client's appearance saying due to "extraordinary circumstances and personal grounds" he could not be present today.
Jina Sena told the court that his client received the summons only on July 8.
Public Prosecutor B V Acharya, objected to the contention of Dinkaran that under 309 Cr. PC it was not mandatory for the accused's presence in the court and the judge upheld it.
The judge granted exemption for personal appearance by Jayalalitha, Sashikala Natarajan, V N Sudhakaran and Ilavarasi, the other accused in the case.
The court also permitted inspection of records sought by N Jyoti, counsel for Jayalalithaa and others in the presence of the court officer.
