Ex-MLAs seek Buta's reports on House dissolution Sunday, July 31 2005 12:24 Hrs (IST) - World Time -
New Delhi:
Former National Democratic Alliance (NDA) MLAs, who have challenged the Centre's decision to dissolve the Bihar Assembly, has filed an application before the Supreme Court seeking two reports of the Governor which formed the basis for the dissolution of the House.
Alleging that the May 23 notification dissolving the Assembly did not state any reasons, they said unless the reports of April 27 and May 21 were not made available to them
it would be difficult for them to challenge the dissolution of the House.
"The Governor's reports are the basis and foundation of the action of the dissolution of the Bihar Legislative Assembly. Unless the contents of the reports are disclosed to the petitioners at this stage it will not be possible for them to challenge the legality and the consequential action of dissolution," the application said.
The four former MLAs Rameshwar Prasad Chaurasia, Bharatiya Janata Party (BJP),
Kishore Kumar Munna (Ind), Rampravesh Rai, Janata Dal (JD) United (U) and Dr Anil
Kumar, Lok Janata Party (breakaway LJP) all elected in 2005 polls accused the United Progressive Alliance (UPA) Government of subverting democratic norms at the behest of Rashtriya Janata Dal (RJD) Chief Lalu Prasad to prevent JD (U) leader Nitish Kumar from staking claim to form Government.
Rejecting the objections of the Centre on entertaining the petition, the court on July 25 had said the former NDA MLAs 'have made out a case' for hearing of their petition matter for a detailed hearing on August one.
