Treading cautiously on the Supreme Court's recent verdict scrapping reservation in private and unaided educational institutions, Bharatiya Janata Party (BJP) today (Aug 23, 2005) said any law aimed at amending the existing provisions should strike a balance between social justice and Constitutionality.
"It is our desire and expectation that there should not be any confrontation between the Supreme Court and the Government," BJP Parliamentary Party spokesman V K Malhotra
told reporters here.
"Whatever law the Government brings to ensure reservation in such institutions should keep in mind its constitutionality and the shortcomings in the existing law brought to light by the Supreme Court", he said.
"We want social justice and Constitutionality to be ensured. We want an end to the confrontationist atmosphere between the Government and the judiciary," he said and charged the Congress-led UPA Government with trying to bring the IMDT through the backdoor after the apex Court scrapped it as "unconstitutional".
