HC to hear petition of bomb blast cases tomorrow Sunday, September 4 2005 12:59 Hrs (IST) - World Time -

The Bombay High Court would hear tomorrow (Sept 5, 2005) a petition challenging clubbing of three different cases pertaining to the bomb blasts that occurred at Mulund, Vile Parle and Mumbai Central in Mumbai. between December 2002 and March 2003, for trial in POTA court.
Justice S S Parkar and Justice A V Modha had earlier stayed the trial a day before the charges were to be framed in the case after accused Addan Mullah moved the High Court
challenging the prosecution's move to club the three cases for trial.
Mullah contended that he was accused only in Mulund blast and was unnecessarily being dragged into other two cases by clubbing all the cases.
They are separate cases and their trial should be conducted separately, he said.
Under the law if all the three incidents formed part of one conspiracy then it would have been possible to club the cases, he said adding, but even that was not the case here.
Mullah had moved the High Court after his application was rejected on July 16 by the special court conducting the trial.
The first blast occurred on December six, 2002 at the McDonalds food joint at Mumbai Central Railway Station, second happened on January 27, 2003 outside Vile Parle railway
station injuring more than 20 persons and the third one on March 13, 2003 inside Karjat-bound local at Mulund station killing 11 persons and injuring over 70.
