The Bombay high court today (Oct 14, 2005) rejected the plea of five accused in the multi-crore fake stamp paper scam probe case, including advocate of prime accused Abdul Karim Telgi, challenging their detention under Maharashtra Control of Organized Crime Act (MCOCA).
A bench headed by justice S B Mhaske rejected their plea for reasons to be separately recorded.
The accused are Telgi's lawyer Rashid Kulkarni, former ACP M C Mulani, former Andhra Pradesh Minister C B K Yadav, suspended police inspectors Gokul Patil and Dilip Kamath.
The accused challenged their detention under MCOCA contending that they were being remanded from time-to-time by a local court in Pune and there was no special court
constituted in Pune under MCOCA.
They argued that only a special court under MCOCA had the powers to remand them as they were booked under the provisions of MCOCA. As there was no special court in Pune, their detention under MCOCA was illegal they said and pleaded for their release.
