A court here today (Oct 27, 2005) dismissed Union Minister Jaiprakash Narain Yadav's application for anticipatory bail in a case charging him with conspiracy with a police officer for facilitating the escape of his brother and Rashtriya Janata Dal (RJD) candidate Vijay Prakash from police custody.
Incharge District and Sessions Judge of Jamui, Subhash Kumar Singh, who had earlier reserved his order on conclusion of the hearing, rejected Yadav's application.
While senior advocates of Patna High Court, Ranapratap Singh and C R Sinha, argued for Yadav, Minister of State for Water Resources, Public Prosecutor Abdul Shaqui vehemently opposed their plea for bail and prayed for submission of the case diary to examine charges levelled against the Union minister in two to three days before passing an order.
Pleading for Yadav's bail, his counsel Ranapratap Singh charged the police with 'malafide and bias' in dragging his name in the release of his brother 'under a conspiracy'.
The police had sounded a state-wide alert for the arrest of Jaiprakash Yadav whose house was also raided in Jamui yesterday when he was not there.
In-charge Chief Judicial Magistrate of Jamui R K Srivastava had on Monday issued non-bailable arrest warrants against Yadav, Prakash, suspended officer in-charge of Khaira police station Mukteshwar Prasad, Independent candidate of Jamui Ashok Ram and an RJD worker Batohi Yadav for Prakash's escape from police custody after his arrest on October 18.
