Bihar: Vijay Prakash Yadav's bail prayer rejected

Jamui: In a further setback to Vijay Prakash, Rashtriya Janata Dal (RJD) candidate for Jamui and brother of Former Union Minister Jaiprakash Narain Yadav, a local court today (Nov 9, 2005) rejected his petition for bail in the case of his illegal escape from judicial custody after arrest on October 18.

In-charge Chief Judicial Magistrate R K Srivastava turned down the bail prayer of Prakash after hearing his counsel Ramlakhan Tiwari and the prosecution.

After playing hide and seek with the police for about a fortnight, Vijay Prakash had surrendered before the court on October 31, which had remanded him in judicial custody till November 14.

Prakash's counsel contended that his client was falsely implicated in the case and that all objectionable articles including a detonator, Rs 6.68 lakh cash and liquor bottles were recovered from another vehicle.

Vijay Prakash only carried his licensed rifle on October 18, the day polling was held in the constituency.

The judge, however, maintained that a prima facie case existed against Prakash and refused to grant him bail.

Former union minister and Prakash's elder brother Jaiprakash Narain Yadav, who had to resign following issue of non-bailable warrant of arrest against him in the same case, was also refused anticipatory bail by Jamui court on October 27.

A criminal revision petition challenging the issue of NBW against Yadav on October 24 by Srivastava is likely to come up for hearing tomorrow (Nov 10, 2005).

Yadav was alleged to have misused his authority to facilitate the illegal escape of his brother, who was arrested with a rifle, ammunition, detonator, huge cash and liquor during polling on October 18.
