Hearing of Jaiprakash's revision petition on Nov 16

Jamui: The criminal revision petition filed by former Union Minister Jaiprakash Narain Yadav challenging the issue of a non-bailable warrant against him in a case charging him with illegal release of his brother and party candidate Vijay Prakash would be taken up for hearing on November 16.

Yadav's counsel Ramlakhan Tiwari said that the petition could not be taken up for hearing today (Nov 10, 2005) as per schedule asnewly-appointed district and sessions judge (Jamui) Mandeshwar Sah, earlier the family court judge posted in Begusarai, was expected to join here on November 12.

The matter has now been posted for November 16, he said.

Yadav, in his petition filed in the court of district and sessions judge on October 28, had alleged that section 409 of the IPC (criminal breach of trust by public servant) was applied against him five days after registration of the case by the investigating officer with a 'malafide' intention and prayed for revision of the in-charge CJM R K Srivastava's order issuing against him.

In-charge district and session's judge of Jamui Subhash Kumar had on October 27 turned down the anticipatory bail plea of Jaiprakash who is evading arrest in the case.
