Order reserved on Jaiprakash Yadav review petition

Jamui: A district court here today (Nov 16, 2005) reserved its order on the criminal revision petition of former Union minister and Rashtriya Janata Dal (RJD) leader Jaiprakash Narain Yadav challenging a non-bailable arrest warrant issued against him in a case relating to 'illegal' release of his brother and party candidate for Jamui Assembly seat Vijay Prakash last month.

Jamui district and sessions judge Muneshwar Prasad reserved his order for later in the day after completion of hearing of Yadav's advocates and the government counsel.

A battery of lawyers, including Supreme Court advocate S K Jain, assisted by Patna High Court advocates Rana Pratap Singh and Chitranjan Sinha defended Yadav.

They termed the Jamui Chief Judicial Magistrate issuing the non -bailable arrest warrant on October 24 against their client as a 'hasty and injudicious' decision and prayed for quashing of the order in addition to deletion of section 409 of IPC (criminal breach of trust by public servant) applied against Yadav later on by the police with a 'malafide'intention.

Government lawyer Abdul Saki defended the police action, saying under Bihar police manual they had every right to include any section for a 'thorough' probe.

After hearing the two parties, the DJ reserved his order for later in the day.

Jaiprakash was alleged to have misused his official position to secure the 'illegal' release of his brother, who was arrested while moving in the constituency with a rifle,ammunition, Rs 6.68 lakh cash, detonator and liquor.

Jaiprakash resigned from the Union ministry amid mounting demand by the National Democratic Alliance (NDA) for his ouster after issue of NBW against him and rejection of his anticipatory bail prayer.
