HC reserves order on Jaiprakash's criminal writ

Patna: The Patna High Court today (Dec 9,2005) reserved its order on the criminal writ petition of absconding former Union Minister Jaiprakash Narain Yadav challenging issuance of non-bailable arrest warrant against him by a court in Jamui, for a future date.

Justice Mridula Mishra reserved the order after completion of hearing of the petitioner and the Government advocates.

Government advocate Lalit Kishore defended issuance of the NBW and application of Section 409 of IPC (criminal breach of trust by a public servant) against Yadav by In-charge Chief Judicial Magistrate of Jamui on October 24 and said any interference by HC at this stage would affect investigation.

Yadav's counsels Rana Pratap Singh and Chitranjan Sinha argued that the order of the Jamui court issuing non-bailable warrant of arrest against their client after addition of a non-bailable section 409 of the IPC on the plea of the investigating officer after four days of registration of the FIR, could not be justified.

Earlier, noted Supreme Court lawyer R K Jain had also argued in favour of Yadav on the same line.

After hearing both the sides, Justice Mishra reserved her order for a future date.

Yadav, a close associate of Rashtriya Janata Dal (RJD) president Lalu Prasad, is on the run and had to resign from the Manmohan Singh Government after the NBW was issued against him for securing illegal release of his brother and RJD nomiunee Vijay Prakash from police custody and his anticipatory bail application was rejected by a court in Jamui in October end.
