HC rejects Rail Ministry plea on Banerjee report

Ahmedabad: The Gujarat High Court today (Mar 20 2006) rejected an application filed by the Railway Ministry, which sought to vacate the stay on the tabling of the Banerjee Commission report in Parliament.

A division bench of Justice M S Shah and Justice S G Dave rejected the appeal of the Ministry and ordered that the report cannot be tabled in Parliament till final hearing of the matter is not concluded in April.

The court also made prima facie observation that the Railway Ministry had no powers to form such a committee in the first place.

The matter had come to the division bench of the High Court after the Railway Ministry had approached it following their appeal being rejected by the single bench.
