The special court hearing the Babri Masjid demolition cases against former BJP President L K Advani, former Union ministers M M Joshi, Uma Bharti and five others today (Apr 15, 2006) fixed April 29 for hearing of the defence application questioning the CBI's right to prosecute.
Moving the application before Special Judge V K Singh, defence counsel Mridul Rakesh argued that the CBI was an investigating agency and could not prosecute in the matter.
The job of the CBI was to investigate and not prosecute, he contended and pleaded that the present case should be the State vs Advani and the others.
He said the Uttar Pradesh state government could launch the prosecution.
The court fixed April 29 for hearing the CBI counsel's arguments.
