Brushing aside the suggestion of the President for reconsideration, the Rajya Sabha yesterday (July 27, 2006) passed the controversial Office of Profit Bill without making any change, amidst stiff resistance by BJP-led NDA The Bill, sent back by A P J Abdul Kalam for reconsideration after it was passed by Parliament in its previous session, was approved with 98 voting in favour and 49 against.
The Parliament (Prevention of Disqualification) Amendment Bill, 2006, which seeks to exempt about 56 posts and seeks the membership of over 40 persons, also saw rejection of an amendment moved by Trinamool Congress member Dinesh Trivedi by 53 votes for and 97 against.
Replying to the debate, Law Minister H R Bharadwaj, who had piloted the bill, said there was no question of 'defying' the President and Parliament looked forward to his observations for guidance.
In democracy, Parliament could not be bypassed, he said.
"The President is a father figure. We are always keen to have his guidance," he said adding his emphasis on probity in public life and upholding respect for institutions of democracy would always be respected.
The Minister said there were certain issues which were judicially decided and some powers that were conferred on Parliament.
The Bill, earlier passed in May, had triggered a major political storm with Congress President Sonia Gandhi being targeted by the Opposition leading to her quitting Lok Sabha and seeking re-election.
