Sealing issue: SC verdict on validity of Sep 7 notification Friday, September 29 2006 12:30 Hrs (IST) - World Time -

The Supreme Court will pronounce its verdict tomorrow on the issue of staying the Government's controversial notification of September seven providing relief
to traders by allowing commercial activities in residential areas of the national capital.
A Bench headed by Chief Justice Y K Sabharwal, had on Monday reserved its order after expressing disapproval over the manner in which notifications were issued to over-ride its
orders on the issue.
While traders have sought that the two notifications of Sept 7 and 15 be made operative, an NGO, Delhi Pradesh Citizen Council, some Residents Welfare Association (RSW), former Chief Secretary in Delhi Government Omesh Sehgal and senior advocate Ranjit Kumar, who is assisting the court as amicus curaie in matter had contended that the notifications were illegal and should be stayed.
The two notifications were issued despite the fact that the court was seized with the petitions challenging the validity of the controversial Delhi Laws (Special Provisions)
Act, 2006, providing a year's moratorium from sealing and demolition drive.
While reserving its order, the court had said the sequence of events from March 28, the day the Government came out with the change in the provision on the mixed land use,
will make it clear about the developments on the issue of commercial establishment in residential areas.
The court was not happy with the government's attitude of coming out with the notifications ever since it delivered its verdict on Feb 16 holding that MCD had the powers to seal illegal commercial premises in residential areas.
On August 10, it had stayed the May 21 notification suspending the sealing drive.
