Justice K G Balakrishnan, senior most judge of the Supreme Court who will take
over as the next Chief Justice of India (CJI), yesterday (Dec 22, 2006) brushed
aside that there was any 'serious confrontation' between the judiciary and
parliament.
"I do not think that there is serious confrontation between the judiciary
and Parliament and judiciary and executive," he told sources.
He said there was 'no serious problem'either for the judiciary or for the
executive.
"Mostly, if some disputes come to the court, people
think it is confrontation," he added.
Justice Balakrishnan favoured good use of Public Interest Litigation (PIL) but
cautioned that it should not be used for ulterior motives.
"The PIL is a good thing. It has worked well in many subjects. Problem
arises when PIL is used by private persons to vindicate their motives and
ulterior ideas," he said.
