New Delhi: Janardhan Nitin Brady, a radio jockey in an FM channel who is wanted by the police for making certain comments on the new Indian idol, Prashant Tamang, over a month ago cannot be arrested for now.
The Supreme Court on Wednesday restrained the West Bengal police from executing an arrest warrant issued by a Darjeeling court against Brady.
Chief justice K G Balakrishnan said Delhi-based Brady cannot be arrested till November 19 when the court takes up his plea for anticipatory bail. Brady has challenged the Calcutta high court order that rejected his anticipatory bail plea late last month.
Jockey’s lawyer UU Lalit, who had successfully pleaded bail for Salman Khan in Jodhpur, drew the CJI’s attention towards the imminent threat to Brady’s freedom. Lalit said Brady was entitled to anticipatory bail.
Brady’s derogatory' comments on an FM channel against Tamang on September 24 were aired in Delhi. The comments enraged the Nepalese community in Darjeeling, Tamang’s hometown. The local police registered a case under section 153A of IPC for inciting violence.
Though the FM channel had tendered a conditional apology, the Nepalese community continues to feel hurt. The army and BSF had to be called in to control violence in Siliguri after Tamang’s fans and local people clashed and torched several cars.The town had virtually turned into a battleground.When the police failed to control the situation, the army had to be called in.
